Terms and conditions of sale

These terms govern the certificate of conformity (COC) service provided by ELEKO SARL under the Homologa name. We act as an intermediary: the certificate is issued by the manufacturer. We owe a best-efforts obligation, with a refund if the document cannot be obtained.

Referred to below as “Homologa”. The other party is referred to as “the Customer”.

Article 2 — Purpose and scope

Homologa provides a service that obtains the European certificate of conformity (COC) from the vehicle manufacturer or its authorised representative, together with ancillary services (paper delivery, translation, registration support).

Homologa is not the issuer of the certificate. The document is issued solely by the manufacturer. Homologa acts as an intermediary carrying out the process on the Customer’s behalf. Homologa never alters, reconstructs or forges the content of a certificate.

eCOC. Since 5 July 2026, manufacturers transmit conformity data for new vehicles to type-approval authorities electronically (eCOC, Regulation (EU) 2018/858, art. 36-37). That flow runs from the manufacturer to the authorities: a private individual does not order an eCOC. Homologa’s service covers the COC, delivered as a digital copy by e-mail and, optionally, as a paper original.

Article 3 — Placing an order

Orders are placed online at homologa.eu. The Customer provides the required information: vehicle identification number (VIN), make, model, country of origin and, where applicable, a copy of the foreign registration certificate.

The Customer warrants the accuracy of the information provided. Any error, in particular in the VIN, that causes a delay, an additional cost or makes the document impossible to obtain is the Customer’s responsibility.

The contract is formed when payment is validated, evidenced by a confirmation e-mail carrying an order reference. Business customers may order by quotation or through the API, on the terms agreed.

Article 4 — Prices

Prices depend on the make, the vehicle category and the options selected. They are displayed including all taxes, in euros, on the brand page, on the price list and at every step of the order flow, before any payment.

The price covers the manufacturer’s fees, data verification and digital delivery of the certificate. Postal delivery and additional services are charged separately and shown before you confirm.

For a business customer registered for VAT in another Member State with a valid EU VAT number (VIES check), the invoice is issued under the reverse-charge mechanism pursuant to article 196 of Directive 2006/112/EC.

Some makes or categories are quoted on request: the price is then communicated before any commitment.

Article 5 — Payment

Payment is due when the order is placed, by card, digital wallet, SEPA direct debit or instalments, through our payment providers. Bank transfer is reserved for business customers.

Homologa never stores card data: payments are handled by licensed providers who alone collect and retain that data.

No approach is made to the manufacturer before payment has actually cleared.

Article 6 — Lead times

The stated lead time is expressed in working days and runs from payment clearing and receipt of complete information. It is specific to each manufacturer: it is shown on the brand page and repeated on the order confirmation.

It is an estimate based on observed lead times, as Homologa depends on the manufacturer’s processing. If it is exceeded, the lead-time guarantee applies as described there.

No part of the service is instantaneous. Any promise of an immediate COC should be treated as suspicious.

Article 7 — Right of withdrawal

Under articles L221-18 et seq. of the French Consumer Code, a consumer Customer has fourteen (14) days from conclusion of the contract to withdraw, without giving reasons and without penalty.

Withdrawal is exercised by any unambiguous statement sent to contact@homologa.eu, or from the customer area. The refund is made within 14 days of receipt of the request, using the same payment method.

Early performance. Work begins during the withdrawal period only if the Customer expressly requests it when ordering (a dedicated checkbox, never pre-ticked). In that case, under article L221-25, the Customer remains liable for the amount corresponding to the service already supplied at the date of withdrawal, in particular non-recoverable fees already incurred with the manufacturer, which are evidenced. Once the certificate has been fully supplied following an express request, the right of withdrawal is exhausted (article L221-28, 1°).

Without an express request for early performance, nothing is started before the 14 days have elapsed and the refund is full.

Article 8 — Impossibility and refund

If, despite its efforts, Homologa is unable to obtain the certificate, the Customer is informed and refunded as set out in our refund policy.

This covers in particular: a vehicle with no European type approval, a manufacturer that no longer issues documents for the model, a non-EU make, or a vehicle built more than ten (10) years ago — article 36 of Regulation (EU) 2018/858 only requires the manufacturer to supply a duplicate for ten years after the vehicle was built.

Where non-recoverable fees have already been incurred with the manufacturer at the Customer’s express request, they are deducted from the refund and evidenced.

Article 9 — Customer obligations

The Customer undertakes to order for a vehicle they own or for which they hold a mandate, to supply accurate information and genuine documents, and to answer requests for further information within a reasonable time.

Any attempt to obtain a document for a stolen or tampered vehicle, or for a non-consenting third party, results in immediate cancellation without refund of costs incurred, and may be reported to the authorities.

Article 10 — Liability

Homologa owes a best-efforts obligation regarding the issuance of the certificate, which ultimately depends on the manufacturer.

Homologa cannot be held liable for delays, refusals or errors attributable to the manufacturer, to an administration, or to inaccurate information supplied by the Customer. Liability is in any event limited to the amount of the order concerned, save gross negligence or personal injury.

Acceptance of a certificate by a registration authority is a matter for that authority. Homologa does not guarantee the outcome of a registration procedure, but reprocesses the request free of charge where non-conformity is attributable to our error.

Article 11 — Personal data (GDPR)

Data provided is processed to perform the contract, to invoice and to meet accounting obligations. Details of processing, retention periods and the Customer’s rights are set out in the privacy policy.

The Customer has the rights of access, rectification, erasure, restriction, objection and portability, exercisable at contact@homologa.eu or from the customer area.

Article 12 — Complaints and mediation

Complaints should first be sent to contact@homologa.eu with the order reference. We acknowledge receipt within 2 working days and answer within 10 working days.

Under articles L612-1 et seq. of the French Consumer Code, a consumer Customer may, after a written complaint has gone unanswered or unresolved for two months, refer the matter free of charge to a consumer ombudsman. The contact details of the ombudsman covering ELEKO SARL are provided on request at contact@homologa.eu and appear on the order confirmation.

Article 13 — Governing law and disputes

These terms are governed by French law. A consumer Customer residing in another Member State retains the benefit of the mandatory protective provisions of their country of residence.

Failing an amicable settlement, disputes fall within the jurisdiction of the courts designated by the applicable rules.

Article 14 — Changes to these terms

Homologa may amend these terms. The version applicable to an order is the one in force on the date of that order; its version number and date appear at the top of this document and on the order confirmation.
